As I said, and am still correct in saying, this reg requires more than "one sale for profit".

I think that is a state-based law but that's actually the same sort of thing. You buy and sell enough cars for profit and the state will come calling and asking you where your dealer license is

I use to sell firearms for a large company. We had an employee we had to fire because when he found a customer who wanted a gun but didn't want to run a background he would buy the gun himself off the clock and turn around and sell to them for profit (considering he got an employee discount and sold it for more than we were, he got a really nice profit each time). He was busted after a lengthy investigation from corporate.

Technically if you buy a gun for $400 (with a receipt) and sell it for cash, they would have to prove that you sold the gun for more than $400 then correct?
