In the OP’s defense, Judge Doughty, who is probably my favorite district court judge, wrote in his order that this may have been a due process violation. Edit: The key word is ***may*** Based on the note from the mother, I think it’s an utterly absurd argument.
So hear out the argument.
As the judge points out, all we have is the word of the government. That’s the problem. And the problem involves a US citizen.
quote:
“The Government contends that this is all okay because the mother wishes that the child be deported with her,” Doughty wrote. “But the Court doesn’t know that.”

The mother took her child with her. This is not the hill the Democrats want to die on is it? Well it probably is.

So you are arguing that long standing immigration policy that gives deportees the right to take their kids with them is a violation of the child’s due process?
What the hell?
What the hell?

Per Trump’s EO, Dora may not actually be a US citizen. SCOTUS will decide that issue in May.

Just take the L, dude.

I’m posting a story about a US citizen that was deported by ICE and a judge that seems to think due process was not provided.
Custody often changes when a parent’s circumstances change. The child’s father appears to want to keep her in the US.
The child may very well be in the best situation in Honduras with the mother.
We have a process for all sides of a dispute to be heard and expect court advocacy for a minor US citizen.

I'd say it's highly likely the mother chose to take her young child with her... why wouldn't she? We're not talking a school age child with roots and friends and some measure of independence... a 2yr old is still entirely dependent on a caregiver.
What yall WANT to happen is for illegal mom to get a pass to stay in the US to raise her "citizen" child. Not today, Satan!

Maybe I'm reading this wrong... but is the "father" wanting Dora to be placed with a third party custodian? It kind of reads that way.
Also... is dad a citizen? I note the interesting "lives in the US" rather than "is a US citizen "... deport his arse too, now that he's spoken up.

No one has said in this thread but feel free to avoid the issue.
The mother, her sister, and the child were detained by ICE on Tuesday during a scheduled field office visit. By Friday they were all deported.
From politico’s LINK reporting of the events:
quote:
Doughty said he attempted to investigate the emergency matter himself on Friday, seeking to get V.M.L.’s mother on the phone to determine whether ICE’s representation about her desire to bring V.M.L. to Honduras was accurate.
Trump administration lawyers called the judge back Friday afternoon and said a phone call with the mother would not be possible “because she (and presumably VML) had just been released in Honduras,”

I don’t know. Maybe a hearing with the mother and father and a court advocate for the US citizen could have answered this. Perhaps the mother was told by ICE that the father was also deported and the child would be sent to a foster care system rife with neglect and sexual abuse of minors. Cops and the government have been known to lie and coerce.

The child, citizen or not, belongs with whichever deported or soon to be deported parent agrees to have her.
Count her blessings... when Dora gets older, she- being a citizen- can come back any time.

The Trump appointed judge disagrees with you.
No he doesnt
quote:
Judge Doughty wrote that the May 16 hearing was "In the interest of dispelling our strong suspicion that the Government just deported a U.S. citizen with no meaningful process."
In fact, the hearing is for the purpose of denying your rumor mongering
quote:
Even as Doughty made clear that he was disturbed by the government’s actions, in his order Friday the judge seemed to tip his hat to the president, adopting the term “Gulf of America” for the body of water traditionally known as the Gulf of Mexico.
quote:
The petition was filed under the name of Trish Mack, who the lawyers indicated had been asked by V.M.L.’s father to act as the child’s custodian and take her home from ICE custody.
The father says ICE allowed the two to speak for about one minute on Tuesday, while the mother was in ICE custody, but that they were unable to make any meaningful decisions about their child.
He was trying to get some woman to take custody of the girl, and his wife said No

I read the petition from your link.
Dad is illegal too and is trying to third party his children's custody, of two, only one is a "citizen".
Also... the mother has spent four years on Intensive supervision... why is that, exactly? And dad is the one that dropped mom and kids off at the INTENSIVE supervision session, the kids were mandated to attend but dad must not have been.
Anyway... bottom line is a family of three came illegally, made a fourth that is the only citizen among them and happens to be all of two years old... and the dad is too scared to advocate for his kids so he's handed it off to someone else... AND... he didn't follow his loving family back to their country.
Messy situation with messy people. I don't care. Dora can come back later as she is a citizen.

Hyper-technically true.
Added context changes everything.

Why do people in this thread keep calling the kid Dora?
I get it’s a device to further dehumanize the people involved, but why specifically Dora? Because Dora the Explorer spoke Spanish?
Posted on 4/26/25 at 12:21 am to ned nederlander
I hope she doesnt leave her 2 year old alone in America.

Because we don't know her name, Ned.
V.M.L.
"the child"
"the toddler"
Dora
Guess which one typed up fastest? Dora.
It isn't- at least for me- about dehumanizing... it is a spaceholder for an unknown name.
Why Dora, specifically?
I followed someone's lead... but liked the moniker because it denotes an hispanic child geared for toddlers and preschoolers. It is positive and plucky, not dehumanizing.
Dehumanizing would be calling her baby beaner, or whatever the honduran version of shaniqua is. Dumbass.
