It's not a fail. Millions of Americans are going to get back pay in the next couple of days and will be able to feed their families. That includes the Coast Guard. If the Dums don't negotiate then they will look like shite for saying they will and it will give President Trump the reason why he has no other chioce but to declare a national emergency.
If the Dums file a lawsuit after he declares a national emergency then the case will be before the SCOTUS in less than a month and the SCOTUS will rule in his favor by at least a 5-4 vote.

I think this was a correction to the mistake of publicly owning the shutdown. Now he can give it a few weeks, (hopefully) not bend when the next shutdown looms, and if it happens, it will be easier to convince everyone that the dems own it this time.
