Yes, but they have to implicate some specific aspect in the Constitution such as the interstate commerce clause or a direct action clause.
They already tried to make rape a federal crime with civil causes of action and the Supreme Court said no, that's a state issue. Oh and Biden wrote the bill and Rehnquist, Scalia and Thomas declared it unconstitutional...just so you know whose side you are advocating here.

That said, I support President Trump taking a strong stance on this matter and think death penalty is appropriate as long as significant evidence is there

I’m not advocating anything. I just don’t think it would be difficult to make what is being proposed federal law.
