And now if witnesses are called, the same court process will have to play out, however will take much longer because that process will start over, whereas it was well underway in the House. Here in the Senate....new subpoenas, fresh assertion of Executive Privilege, new court action to enforce said subpoenas.

So in the name of keeping a particular impeachment timeline they punted the executive privilege issue to Senate. And argue "it would have been tied up in court too long," while in doing so, they've ensured it would and will be tied up in court even much longer now.

I overheard this morning that Shitt or their team is going to try and disqualify Trumps team today. On the grounds that Cipillone is a fact witness.
