n Tuesday, word came that the legal disciplinary authority in Washington, D.C., was charging U.S. Pardon Attorney Ed Martin with ethics violations, kicking off proceedings that could result in penalties up to and including disbarment.

quote:

These are but two of the myriad, often dubious, and historically unsuccessful but nevertheless crippling complaints brought against conservative lawyers, typically by the left’s lawfare apparatus, before like-minded state and local disciplinary authorities across the country — a practice, “Barfare,” about which I reported last fall for RealClearInvestigations. By making life hell for conservative counselors by hitting them with such complaints, the idea is to pick such legal talent off the playing field — while spooking others who might otherwise enter it — and thereby eliminate the left’s legal opposition.
quote:

Under the proposal, should a third party lodge a bar complaint against such a lawyer alleging that he committed ethical violations while conducting federal work, or should disciplinary authorities “open an investigation into such allegations” absent a complaint, the U.S. AG would have a “right of first review” — to examine the case and suspend disciplinary investigations or proceedings pending the conclusion of her examination. Should bar authorities refuse to comply, the department could then “take appropriate action to prevent” such interference.

quote:

In justifying the rule, the Justice Department noted that “political activists have weaponized the bar complaint and investigation process”

I guess they need something to do. I would’ve preferred frog marching Tim Walz and Jacob Frey.

I was willing to give Bondi a shot but the AG is one of the most important roles and I think it needs to be a man. Not sorry

We’ve had some terrible male AGs under Trump as well.

The GOPe just won’t let someone effective they don’t control like Ed Martin get through the nomination process, the Thune/McConnell/Cornyn wing will pull their votes.

Bad male AGs under Trump as well

This is the gods truth. I don’t care who gets done what needs to be done, I just feel like someone that will is more likely too that’s a man. Perhaps someone young that doesn’t look like he’s about to die, brave, believes in the cause, and above all understands the seriousness of what we are trying and need to do.

AG candidates do not get approved by the Senate unless they can be controlled

Boasberg and most of the DC judges need impeached ... too bad the Republicans wont do their jobs.

Jeanine had a presser about Boasberg blocking her.

The Department has concluded that this language requires that Department attorneys be subject to the same substantive State ethics rules as every other attorney in that State, but that because Congress did not expressly confer to the States enforcement authority, the statute otherwise preserves the authority of the Attorney General to enforce those substantive standards.

Yikes. Where are my 10th Amendment bros at?

At first glance I thought this was just about the DC bar (As its a federal district) but this is hijacking the disciplinary process of all 50 states. Major federal encroachment of states rights.

It has the employer of the attorneys (the AG) doing the review, which is a conflict of interest, and this rule doesn't even seem to have any timeframe for the review.

There also isn't clarity what happens if the OPR doesn't find ethical violations. The rule says if the OPR does find ethical violations the state bars aren't bound to only that discipline and can impose more, but is silent as to the opposite. If there is no impact, this is just a delay tactic that has no substance.

This regulation is a mess conceptually and politically.

Wasn't the congress critters going to impeach Boasberg?

Jeanine should have mentioned this in her announcement yesterday.

Ed Martin is being attacked by the bar for being exactly that.

Todd Blanche, the #2 at DOJ is pushing him out of that agency for that very reason.

Blanche is basically the deep state blocker at DOJ currently and has been front and center for killing the Epstein case and others.

As soon as they announced he was going to stay on as #2 I knew we were cooked.
