But that begs the question; if article 1, section 8 authorizes the federal government to "to lay and collect taxes" why was the 16th amendment necessary?
A consumption tax doesn't qualify, since it's collected on transactions and not individuals. We've collected consumption taxes basically forever.
Let's please skip the part where you Google a tendentious law review article by some obscure professor and treat it as equally binding authority.

I know at state and local levels we have collected sales taxes forever but at the federal level? Also excise taxes which sometimes fall in the category of consumption taxes are collected before the sale to the end user (unlike sales taxes).
In this thread and most of the time consumption tax is synonymous with sales tax. I should have made the distinction between the two even though sales tax falls into the broader category of consumption tax.

That makes sense especially using excise taxes as an example.
However sales taxes are collected on individuals, the consumer.
