The question right now is were those wiretaps legal? What was their "probable cause?" You can't just tap the phones of a political campaign because you're mad that you lost an election.
Make no mistake, the Democrats would be furious right now if the shoe was on the other foot. Can you imagine if Bush had tapped Obama's phones in 2008? Do you really think they'd be cool with it?

Again, I would bet there is an irrefutable paper trail leading to an actual wiretapping that is impossible to refute so they had to shift the argument prior to it being released. That's my guess.
OKAY - That is a slant I had not considered. It would mean this has to be fought out in the court of public opinion rather than a court of law. Getting the ball rolling with a 'quick kick' tweet may be a level of 17-d underwater spherical chess I am not smart enough to analyze.

Can't confirm yet but read only about .5% of warrants are denied, but even then can usually be revised to be granted.
