This was the "pamphlet":

They stuck these in the doors of synagogues and black churches. I think the whole "hate speech" thing is utterly ridiculous but I can see how this could rise to a charge of intimidation or aggravated harassment.

In that same vein I would expect people posting fliers on behalf of BLM or the Black Panters with the "black power" symbol on it and sticking them up at predominantly white churches be treated the same, but we all know that wouldn't happen.

As stupid, awful, and disgusting as I find these troglodytes, I don't think this constitutes a threat. I can heavily disagree with someone's viewpoints, but I will be damned if I don't protect their right to say or post it.

Clearly giving this to a Jew or a black person is intentionally intimidating them.

Do I think This deserves the sentence that comes along with a hate crime? No

Is this protected by free speech? Also no. Free speech doesn’t allow you to harass or intentionally intimidate people.

Did some city or state pass an ordinance or statute that makes this behavior illegal? Maybe. But it will not survive 1st Amendment scrutiny.

If they can do this, they would also be able to arrest a good Southern Baptist for passing out tracks, correct?

I really hope "intentionally intimidating" isn't the threshold to illegality.

Do you think people should be able to intimidate and harass freely?

This isn’t someone saying “I hate Jews” on a public corner. I firmly Believe people have a right to be Nazis and speak about that publicly. But there is a difference between that and throwing mein kampf at a synagouge.

This is a threat.

When hate crimes first became cool, we were assured that no one would be guilty of such an offense unless there was an underlying "real" crime (murder, rape, etc.). Another broken promise by the left.

There is an underlying crime here but it’s a petty one that I don't Love hate crime penalties being attached to.

If a militant black power group taped some incendiary white devil shite to my front door (white family) I sure as hell would hope that would be punishable in some way. When free speech crosses over to threatening or harrassing, the courts have already decided this is not ok, over a hundred years of precedent. I agree there is a problematic gray area, and there always will be. But this particular story, if it went down the way the AP says it went down, isn't that big of a deal. They probably deserve the charges, if it went down the way the story says it went down.

Hello fellow white supremacy enthusiasts!

Who, exactly, are you referring to?

I, myself, am a free speech enthusiast, even for the vile scum noted in the OP.

Free speech makes it difficult to prosecute white supremacy in America

The First Amendment is a major block in investigation and prosecution of a white supremacy group.

Prosecutors were empowered to charge and try large swaths of people in the same case, at the same time, for disparate crimes as long as those crimes were committed in service to the same organization. At trial, prosecutors were able to enter in evidence that may not otherwise be admissible, such as newspaper articles or mob nicknames.

It’s not a written law. It’s a culture

Sorry, but people are allowed to have their own beliefs in the US. Whether it be white, black, asian nationalist, doesn't matter.

They weren’t standing on a public side walk passing it out, there were targeting Jewish and black churches. You could argue to intimidate them.

They left pamphlets at the door.

Far less than what BLM has done on private property without any repercussions

Man, I totally disagree. I don't think there is anything aggressive or threatening about what those flyers say. Maybe because they placed them?
