The only thing my mind can come up with is if it was still material evidence for another case related to the incident...otherwise, it needs to be returned without a hassle. He has already been put through the ringer enough!

At the time of his acquittal it was still being used as evidence in the case against Dominick Black so he didn't really have a legal claim to ask for the gun back at that time.

That IS his rifle. There are many like it, but that one IS his.
Hope he isn't giving up on his ability to defend himself. He can get another one if he so chooses. And he is free to not get another one.
