Can a lower court judge override the Supreme Court? The USSC already allowed the Texas law to stand. Now after the fact this judge writes an injunction he or she knows won’t stand and you act like it’s Texas’ issue? BS.

Would you all support a law that weaponizes citizens against one another for any other topic? The idea of the state writing a law that they themselves can’t enforce under that law is stupid.

The states define civil damages all the time.

I think it's stupid to do for abortions because if our country wasn't a clown show they could simply outlaw abortions.

Yeah, well Biden's DOJ will surely sweep in and enforce the court order... For some reason it doesn't work the other way around...

If Abbott had any balls about him, he would call the bluff and be prepared to block DOJ...

Already ruled on by the Supreme Court.

The judge has no standing.

The law will remain in place.

The question isn't whether the Texas Supreme Court will overturn the ruling. This will happen, and it will take 2-3 months, normally. The question is whether or not the injunction is stayed and the Texas law allowed to continue in place during the appeal. That should happen in the next few days.

The Texas Supreme Court will never see this case, as it was filed in federal court and not state court.

Next step in the proceedings will be U.S. Court of Appeals for the Fifth Circuit, and the State of Texas has already filed a notice of appeal.

Judge Pitman left no doubt as to his thoughts on the law:

Finally, the State has requested, in the event the Court preliminarily enjoins enforcement of S.B. 8, that the Court stay any injunction until the State has the opportunity to seek appellate review. The State has forfeited the right to any such accommodation by pursuing an unprecedented and aggressive scheme to deprive its citizens of a significant and well-established constitutional right. From the moment S.B. 8 went into effect, women have been unlawfully prevented from exercising control over their lives in ways that are protected by the Constitution. That other courts may find a way to avoid this conclusion is theirs to decide; this Court will not sanction one more day of this offensive deprivation of such an important right.
