Article 1, Section 4 gives power over federal election administration to the States. Determining who is eligible per the plain text of the Constitution is part of administering them.

He was found to have engaged in it while an officer of the United States. Which is exactly what the 14th Amendment says you can't do if you ever want to run for federal office again.

If insurrection is a political question and not a legal question, then every democrat who cheered on the “summer of love” and is helping to facilitate open borders is guilty of insurrection.

There was no insurrection.

He didn't even engage in the protest that did occur.

And, there's been no finding by any court that says otherwise.

That's the problem - he's not. If he hadn't engaged in insurrection while an officer of the United States he would be, but once he did that he made himself ineligible.

Ok here is your chance to show everyone how smart you are.

First, what government authority gets to define insurrection? State or federal?

Specifically which branch of government?

Second, tell me any state that has the authority to interpret the federal constitution

Third, tell me which hat are the specific burdens required for removal of a constitutional right by a state, assuming they are allowed?
