One thing Noem had correct is that Habeas Corpus can and has been suspended before.

So even if you do not know the law you can deduce a couple things just from this interaction alone:

1. If HC can be suspended, it is not a god given right and is NOT inalienable.

2. If it is not inalienable (i.e. alienable) the it is not by default a right extended to non-citizens. It may be extended, but not by default.

3. If it isn't an inalienable right, and not by default given to all persons then it being part of due process is indeed open to debate and adjudication.

The liberals are confusing detention with deportation. I'd say we/the right are too. The law of the land says that illegal aliens SHALL be detained. No if ands or buts. The intent was so that they do not endanger US citizens pending deportation. NOT to decide whether or not they should appear before a judge and decide whether or not to deport them (which is Habeas Corpus). That's what has been twisted up here.

Note that Biden had to grant ADMINISTRATIVE parole to illegals to avoid NOT deporting them from an ADMINISTRATIVE court not part of the judiciary. If that parole was not granted, then they were required to deport them; habeas corpus not required.

ETA: above is why it was both overkill, unnecessary, and pretty stupid to even try and use the AEA as several posters have noted (not myself). It opened the door to that interpretation. However, they were trying to nullify those paroles granted by the Biden administration in lieu of just revoking them.... which the judges would have then blocked the revocation. It was the lesser of two evils choice.
