• Creation: Established by Congress in 2008.
• Congressional Offsets: Congress previously reduced or tapped baseline balances around 20 times to offset other legislative spending.
• Direct Administration Spending: Previous administrations and CMS had never spent the money on direct healthcare improvements or beneficiary rebates until October 2026.
The bolded part seems to make the slush funds claim true.
The President can direct how it is spent...to a point...but only Congress can do away with it.
