SCOTUS rules on Oklahoma case

Basically in a 5-4 decision, they ruled :


"Not only does the Court discover a Creek reservation that spans three million acres and includes most of the city of Tulsa, but the Court’s reasoning portends that there are four more such reservations in Oklahoma. The rediscovered reservations encompass the entire eastern half of the State — 19 million acres that are home to 1.8 million people, only 10%–15% of whom are Indians," he wrote.


So that just got a little more complicated.

Bad news for the indians. The reservation is a prime example of what happens when government gives you things. I understand the genesis of the project, but eventually, you have to assimilate and strike out on your own.

Its pretty striking as a ruling.

I'm not sure how that territory will be governed.

So what happens? Any white people there now are forcibly moved to the other side of the state in a Jeep Cherokee Trail Of Tears?

Well, I think one could easily claim habitation and improvements made on the land for at least 5 years in most cases.

City of Tulsa is now governed by tribal leaders. Maybe the new leaders can made a deal with the UN or China to come in and 'help out with things'.

Funny side effect for that would be to make the song “Okie From Muskogee” outdated since that is in the vicinity of Tulsa.

The Indians who were here before us have to assimilate to us after we gave this land to them?

They don’t HAVE to assimilate. But living on tribal land at the chief’s discretion certainly kills a lot of innovation and investment.


Go out into states like Arizona and New Mexico. You can tell where private land ends and reservations begin because it looks like your watch just got set back 100 years.

Does this ruling mean all of eastern Oklahoma now belongs to the indians? Article sounded like that isn't the case.

Personally, I think we should carve out the rest of the State of Oklahoma for the black folks... call it "New Wakanda" and watch as the Indians and black folk fight it out on border disputes...

Not really, at all. The ruling is not a broad territorial or sovereignty determination. It applies only within the context of the Major Crimes Act, meaning that certain crimes committed in that area by Native Americans are subject to federal and not state prosecution.

Oklahoma is not giving control of Tulsa over to the Cherokee Nation.

Then you clearly have no idea what the actual issues were in the case. It has nothing to do with the governance of the area in question.
