Not me. I specifically argue from a position of principles and win on those. The hypocrisy of so many makes that possible (not everyone is a fan of smaller government, so "winning" is more subjective in those discussions with authoritarians).

Your reading comprehension needs work. The foreign nation or government line is talking about if there is a war declared. Like how in ww2 they took all the Japanese in the U.S. and put them in camps.

Our current case law is basically the case law.
There are a few cases from WW2 that aren't really applicable now, as there was a 100% legally-declared war as the back drop.

How about Mexico? Any of Central America or other South American countries? We have like 280,000 Chinese students here -- is that an invasion or predatory incursion?

I don't know. Are those students drug runners or gang members? We are going after the Mexican cartels, because they are poisoning our citizens. It's an act of war.
