Now, establishing that intent would be somewhat problematic, if he did not in fact TAKE anything.
Let's take you and your wife walking thru homes under construction in your neighborhood. Yeah, everyone does it. I do it.
If you walk through that site (in Georgia), you do NOT commit a felony burglary if you just intend to look around and see how the bathroom is laid-out. But you HAVE technically committed a trespass if you have been warned not to enter (perhaps with a "no trespass" sign?).
