All Roberts was doing with the “don’t second guess the elected officials and experts” is uphold a 115-year-old decision, Jacobson v. Massachusetts.

If they want to overturn Jacobson in whole or in part, then they should wait for that opportunity.

They were trying to have their cake and eat it, too.

Example: Yes, state and local governments can do this under Jacobson, but...
