Joel Greenberg is in big boy trouble for using resources available to him through his position as county tax commissioner to make fake IDs. The reason for those IDs remain largely unknown, but one can guess. When it comes to statutory rape/sex with underage partner laws it’s just the opposite. Strict liability (no element of intent required).
It would defang those laws if you allowed the adult the defense that they thought the underage partner was of age (my bad). Instead it’s 100% on the adult to be sure.

As an aside Gaetz is being investigated under federal law that makes it a crime to induce girls under the age of 18 to cross state lines for the purposes of having sex for money or other considerations.
So various state’s ages of consent are irrelevant here since this law will apply in any state. It would still be a crime in Louisiana (other prior posts on the thread) as long as you were paying to bring the girls in from out of state.

It’s a federal investigation based on violation of federal law, so individual state’s ages of consent are irrelevant (to the extent they are more lax) and this could have just as easily have been investigated in Louisiana if state lines were crossed.
That being said your point is a good one outside of the Gaetz context. In South Carolina (and other states) the age of general consent (can have sex with anyone of age) is 16, Louisiana (and other states) 17, and California (and other states) it’s 18.

No Gaetz is not a stupid guy. He knows that you can’t make the kind of waves he does a a Republican and then go screw around with some chick that’s underaged. The media and Dems hate this guy and would have looked for and found something like this years ago to use against him. All I’m saying is that I’m not going to rush to judgement on this because I just don’t think we have all the info yet.

You are correct. The “knowingly” for underage sex in Texas deals with “knowingly” penetrating. Not knowing the age is irrelevant.
