Second, the military is a far far less friendly venue than you apparently suspect. Kelly won't end up in the brig. But if the case gets brought, he'll lose his military pension.

Those asshats deserve everything they get. Advising active duty military to disobey unlawful orders is dangerous for the service member. There would be a review to determine if it was an unlawful order and if it wasn't unlawful they can get charged. Having a bunch of people get hit with bad paper is irresponsible, not that the politicians care.

1. Trump will cause the Pentagon to recall Kelly to active duty and then to charge him with some marginal crime.
2. Trumpists will cheer and do victory dances in the streets.
3. Courts will shoot this down, quickly and firmly.

If you want to extend that principle to ANY action undertaken ANYWHERE by a military retiree in his civilian capacity, this is not a very good test case for you.
