Wouldn't there need to be an FEC charge of campaign finance violations first?

Sure. There's not anything criminal about the meeting or the relationship per se, but it does give us more information about AMI's intent with regard to helping the Trump campaign (not just DJT). From SDNY yesterday:

See, this starts to look like a conspiracy to violate campaign spending law.

It’s gonna be hard to prove intent. All I have to do is say, “is it possible Mr Cohen that Mr Trump didn’t want his wife to find out? Could it be Mr Cohen that Mr Trump wanted to save his marriage and spare his family from public humiliation. Is it possible Mr Trump never brought up his family because of the incredibly tenuous situation he found himself in. Wouldn’t you agree Mr Cohen that Mr Trump could be especially embarrassed because of the nature of Mrs Daniels work”?

Sure, that's always the tough thing about proving white collar crime - the intent.

Lucky that Trump is pretty open about telling us his intent (as with the obstruction case). He'll probably say some boneheaded things to tell on himself.

ETA: (if he hasn't already - who knows what's been said at the grand jury already by the other witnesses about their meetings with him).

I do not see that anyone has pointed out that according to the SDNY's sentencing memo, the catch and kill arrangement was reached in August 2014.

quote:

The Chairman and Chief Executive Officer (“Chairman-1”) of the media company that owns Magazine-1 (“Corporation-1”) had a prior relationship with Individual-1 and Cohen. In August 2014, Chairman-1 had met with Cohen and Individual-1, and had offered to help deal with negative stories about Individual-1’s relationships with women by identifying such stories so that they could be purchased and “killed.”

It would have been extremely difficult to have proven that Cohen had the intent to violate FECA and therefore next to impossible to prove that Trump, relying on counsel's advice, to have known that such conduct would have violated FECA:

quote:

The FECA specifically gives the Commission the authority to interpret the features of the FECA....The role of the Department of Justice in matters arising under the FECA is confined to prosecuting violations of the Act's provisions that are committed "knowingly and willfully." ....For such a criminal violation to occur, the application of the law to the facts of a matter must at the very least be clear, and there must be no doubt that the Commission considers that the underlying conduct presents a FECA offense.

In other words, unless there is clear precedent from the FEC that in which certain acts have been deemed to be violations of the campaign finance laws, one cannot knowingly and willfully violate the campaign finance rules.

Interesting, this was before Trump ever talked about running for President

Sort of. He's talked about running for President on/off for years and never did (though he made especially loud noises about it in '12 following all his notoriety as an Obama critic/birther), but he's used the Enquirer for a long time to do puff pieces and go after his enemies in NYC. He'll use the defense that AMI did this because they always do this for me.

Look at all the anti-Hillary covers from campaign days:

The ability of government to deny freedom and destroy people through the interpretation of thousands of murky agency rules that the average person has no clue about, should scare the shite out of everyone.

Is there ANYTHING that Trumpettes will not buy, so long as their Orange Deity tweets it during his morning ablutions?

If he were to tweet that he is tasking NASA with mining bleu cheese on the moon and returning it here for resale, I suspect his followers would stock up on salad forks.
