MTs don't afford the full panoply of US Const rights to unlawful enemy combatants. MTs were ruled Constitutional.

I think Bergdahl's trial ends today. Maybe he will get beyond life in prison and will get the the death penalty; and he can join Nidal Hasan the POS who in court pledged terrorism and asked to be a martyr-- who infiltrated our military as a terrorist.

Military tribunals are Constitutional. Admittedly, they slipped my mind. That said, it does not come into play until the CSRT reviews the case.

We’ve prosecuted jihadis before. We’re now prosecuting the biggest drug lord in the world.
It’s a show of American strength that we just shuffle these guys in through our system. No special tribunals or special procedures because what you did is not special. It violated federal law and you’ll get treated just like any other common criminal who violates federal law.

There's a big difference between Mirandizing someone arrested in the US versus Mirandizing captured fighters in Afghanistan and Iraq, which the Obama administration was going. The former I tend to be okay with, especially if they are in the US on legal visas. The latter is a very big problem, you're essentially extending constitutional protections to non-citizens engaged in active warfare against the US on foreign soil.

I’m torn on the subject.
I feel like US citizens should always be afforded all of their rights and tried by civilian courts for any crimes committed on US territory. Members of the armed services who commit “military” crimes and any crime on military land should be tried in military courts.
I also think there should be a mechanism by which it could be determined that an action (like joining a military of a nation at war with the US) would “renounce” your citizenship. This would effectively make you, in the eyes of the law, a combatant of the US; the military courts could then handle you accordingly.
Perhaps in this case (or in the case of the Boston bomber, etc.) there would be a hearing to determine the terrorist’s affiliation. If this court decides he’s a full citizen then he gets tried the same as anyone else; if the court determined he’s not a citizen then he’s handed over to the military.
Honestly I see opportunities for corruption no matter how we go about it - corruption in the vain of activist judges, and in the vain of an overzealous prosecution.
