I'm a little taken back that he tweeted " death penalty".
Most of us are quite okay with that outcome after he suffers tremendously from interrogations, but not sure I like the POTUS tweeting that.

I actually disagree with Trump here.
I’m happy to spend my tax dollars toward brutally torturing this piece of shite for a while.

Trump doesn't tweet as the president. He tweets from the POV of the average everyday American. Accurately too

This is the problem with a president who is unhinged and dumb as a brick. Whether he is correct or incorrect his head up his arse stupidity prevents the people around him from doing their jobs effectively. But hey, at least this time the guy is guilty unlike the time this idiot took out a full page ad asking for the execution of 5 innocent boys. I wonder why he didn't call for the death of the Charlottesville driver????? Or why most of the FoxNews fans and Scammity fans on here did not either? We all know why.

I don't disagree, but there is no mechanic within the Constitution, regardless of your crime (even treason) that allows for forfeiture of your Constitutional rights.
For good or ill, that is what our forefathers wrote into the Bill of Rights.
The Ninth Amendment:

There was a chance right after 9/11 to activate a Military Tribunal modeled on the one in this case. The fear was that the Left would never allow it and, of course, no non -Leftist would fight for setting it up. The "cave in" to the Left was immediate and happened without even a whimper.
MTs have streamlined process for unlawful enemy combatants. When done correctly, MTs can be vastly more efficient than a federal court in Manhattan.
But we should forget about MTs now. They will never happen. MTs aren't even on the radar screen.
Here's the case:
Ex parte Quirin
SO, since we will never have MTs, lets send the guy to a federal criminal court in Manhattan to make sure that he has the full and strong panoply of US Constitutional rights afforded to every peaceful US citizen. AND let's make sure that he has the right to preach from the witness stand about the evils of White Racist KKK USA.

... and when he is still convicted and sentenced to death after and fair and open trial, let’s remember we still have the greatest and fairest justice system in the world.
