That's exactly how they were selected.
School has no wheelchair ramp?
That means they have no handicapped kids.
That coupled with that it's a test in school makes it a perfect case.
You go to court and you mention all of this.
They want punitive damages, so they want to trigger:
Intentional Misconduct: When harm is caused deliberately or through malicious conduct.
Do you think they picked the school because it's academics?

What happens if all they get is the kid goes to the school
No amount of education is going to help that kid.
So how do you calculate damages?

I don't think so. The all-charter system complicates things but IDEA ensures that all students receive a "free and appropriate education." It doesn't ensure admittance into their school of choice. Because of the all-charter model, the kid is eligible to go to any open-enrollment school across the city.

Woudn't an admissions test let educators know where the kid is at mentally/grade level for proper placement.
Plus why are they seeking to place their child in a school whose mission statement says its geared toward academically GIFTED students. What prior GIFTED school did their child attend previously?

You're thinking of a diagnostic test. The test at Willow determines if the child will be accepted into the school. Students have to achieve a certain score to be admitted.

I had jury duty in the fall and the guy I happened to sit next to in the place potential jurors have to wait was a radiation oncology medical physicist. I don't remember any trashy people being in the room either.
Just because someone gets a summons doesn' t mean they will show up.

This is true, but there is big money involved in keeping people stupid. One way they do that is by funding lawsuits like this and destroying things that are meant for the best and brightest only. The goal is to bring everyone down, not build up the extraordinary.
We are the only country in the world that values the lowest common denominator above the high achiever.
