Too bad the school board is operating in a deficit.

Seems more likely to me this is about stirring up shite (probably pushed and funded by some sort of weird "advocacy" group) versus seeking any sort of "payday."

Guess I suspected rightly.

That's probably an ADA violation for a school.

ETA: After reading through the laws, it's definitely an ADA violation.
Probably why they were approached in the first place.

They aren't suing over wheelchair access.

That's exactly how they were selected.

School has no wheelchair ramp?

That means they have no handicapped kids.

That coupled with that it's a test in school makes it a perfect case.

You go to court and you mention all of this.

They want punitive damages, so they want to trigger:
Intentional Misconduct: When harm is caused deliberately or through malicious conduct.

Do you think they picked the school because it's academics?

No, I know they picked the school because of academics. They know their son cannot get into it. He could not possibly be admitted to any school with admissions standards.

Yea and what happens if they win?
What happens if all they get is the kid goes to the school
No amount of education is going to help that kid.
So how do you calculate damages?

quote:

Economic Damages = Back Pay + Front Pay + Medical Expenses + Legal Expenses
Non-Economic Damages = Compensatory and Punitive Damages
Total Settlement Value = Economic Damages + Compensatory and Punitive Damages

Economic = Legal Expenses

Non Economic
quote:

Compensatory damages compensate the employee for damages such as pain and suffering, emotional distress or emotional harm, harm to reputation, medical bills, job search costs, and other out-of-pocket expenses.

How much harm is this kid having, he's not going to be aware what schools he's applying to.

Punitive Damages
quote:

Punitive damages punish the employer for particularly egregious discriminatory or retaliatory conduct and to deter similar behavior in the future. For punitive damages to be awarded, an officer, director, or “managing agent” of the company must have done the egregious act.

They want money.
They were the ones that mentioned the lack of ADA Access.

They are hoping for a settlement.

They'll get a settlement because school systems are cowards.

Not disagreeing, but also considering the jury pool the school could get hosed in a trial.

I don't think so. The all-charter system complicates things but IDEA ensures that all students receive a "free and appropriate education." It doesn't ensure admittance into their school of choice. Because of the all-charter model, the kid is eligible to go to any open-enrollment school across the city.

Woudn't an admissions test let educators know where the kid is at mentally/grade level for proper placement.

Plus why are they seeking to place their child in a school whose mission statement says its geared toward academically GIFTED students. What prior GIFTED school did their child attend previously?

You're thinking of a diagnostic test. The test at Willow determines if the child will be accepted into the school. Students have to achieve a certain score to be admitted.

I had jury duty in the fall and the guy I happened to sit next to in the place potential jurors have to wait was a radiation oncology medical physicist. I don't remember any trashy people being in the room either.

Just because someone gets a summons doesn' t mean they will show up.

This is not being violated by a selective admissions school. The parents can enroll him in many other public schools for a free and appropriate public education.

I was imagining people who are extremely soft when it comes to disabled children.

I mean while not being a lawyer I can't imagine wanting to fight it out on technicalities against a disabled kid.

This is true, but there is big money involved in keeping people stupid. One way they do that is by funding lawsuits like this and destroying things that are meant for the best and brightest only. The goal is to bring everyone down, not build up the extraordinary.

We are the only country in the world that values the lowest common denominator above the high achiever.
