I recall Sidney Powell reeling off a few case precedents to the appeal court. One of the three appeals court judges asked this question IIRC.

You are trolling. If the DOJ is committed to justice and recognized 1) the many improper elements to this prosecution, and 2) their own evidence points to this man's innocence, it would be against their oath to propose a light or no sentence in this case.

That's not what is going on here.
You are rehashing the arguments already settled by the 10th. Flynn was allowed to change is plea due to Brady material from the U.S. attorney's office. Sullivan allowed him to change it. That same Brady material forced the DOJ to drop the charges.

I would like to think what the FBI/ DOJ did to Flynn was unprecedented....but I don't.

That's the thing, not sure its unprecedented at all. Meaning he withdrew his guilty plea and DOJ is basically in agreement that it should be withdrawn. The reasons are more or less known.

Any "burden" Sullivan may have felt regarding the need, as a judge, to make sure there was nothing untoward or coercive in the Prosecutor's decision to abandon the case was relieved as soon as the Appellate Court issued its ruling. If Sullivan really felt some "noble calling" to make sure all was by the book, then that crusade, and any responsibility he may have felt, ended when the Appellate Court issued its ruling. If you assume this was "noble", then he did what he should have done. But that is over now. There is no basis, other than politics, that can logically be argued to explain the refusal to comply with an Order from the Court of Appeal. None. He's not a defendant seeking relief from an adverse ruling. He's a judge who has been told to dismiss a case...one which he is supposed to be impartial toward. The behavior of Sullivan is hard to understand barring poltical bias.

Because they cannot prove materiality with regards to a false statement. And the evidence to prove that was withheld by prosecutors at the time he plead. He was also represented by counsel who had a massive conflict of interest because they had done the FARA filings which the DOJ was holding over his head. This entire case is Exhibit A in what prosecutorial misconduct and overreach looks like. But because Flynn is a Trump supporter, this is business as usual.
