Unprecedented for sure. Article III judges like Sullivan are super serious about being respected as an equal branch of government. Technically once he plead the prosecution of the charges was complete, and he was a ward of the Court for sentencing. That’s what complicated all of this. En banc on something like this isn’t something I have a huge problem with. The record should be well-developed. There are novel constitutional questions in play.
