Premiums haven’t fallen 10% in any post-tort reform state. Greg the GoAuto guy is commissioning an 8-figure yacht, pre-tort reform. The insurance industry is not hurting.

That’s baloney, more like non-lawyers who are sick of people crying hurt back, whiplash, pain and suffering over every single fender bender in hopes of winning the injury lotto.

The CEOs and executives for these billion dollar companies appreciate your willingness to give up your only method of recourse to aid their struggling companies. I’m sure they’re going to pay all legitimate injury claims out of the kindness of their hearts.


Texas says hello. Their ability to build wealth for citizens makes your post look totally biased and small minded.

Only on Louisiana will people actually argue that we can get ahead in life by stealing from each other, cheating each other and, in your case, suing each other.

You in the industry or sat on a lot of juries recently?

Or are you just making this up because a well-oiled abd well-funded LABI public relations machine has told you this for the last decade or two?

Personal experience

The whole system is rotten to the core, why should either side be able to contribute to a judges campaign who will ultimately decide cases up to $50k? Why is it seen as a positive that we have one of the most sue happy states?

Please enlighten us as to how people suing the hell out of each other for even the most minor of accidents is a net positive for this state.

Still has a long way to go but I remember Mike Foster getting a 10% reduction in the law. That 10% reduction equals a 75% increase since it passed

How about seizing uninsured cars, garnishing wages of uninsured who injure people, put drunk drivers away?

Are they still trying to lower the jury threshold? How easy do you think it will be to seat a jury anytime in the foreseeable future? Hundreds of people in the jury pool room waiting to get herded through the courthouse like cattle so they can be picked to be crammed like sardines in to the jury box. What happens when somebody coughs?

I really don’t know enough about either side to make a judgement.

The thing I keep coming back to for those who don’t think Louisiana needs reform is... do you think Louisiana is the only state that has it right and that all other 49 states should follow our ways? That they are not nearly as protected as we are from the Terrible insurance companies?

All I know is that their pushing to get a unified bill voted on, passed, and to the governor before the end of this session.

Most notably, elimination of the collateral source rule and dropping the jury threshold to $5,000. Frankly, I think $5,000 is too low but collateral source is a joke and needs to go.

I don’t think you know how infrequently PI cases are tried to a jury.

Collateral source elimination is HUGE.

I tried a case in February where the Plaintiff blackboarded $220k in meds, almost every single penny of which was paid by his health insurer. Judges in MS get questions from the jury all the time about whether a plaintiff had health insurance.

As to the jury threshold - MS’s is $200 and our courtrooms aren’t overflowing with PI jury trials. Like I said in previous pages, jury trials force people to get real about their cases. I’ve seen juries zero a plaintiff in a parking lot accident even where liability was admitted and there was a surgery. Conversely, a jury in Biloxi recently awarded $1.5m to a little boy who had his eyelid ripped off by a clothing rack at Dillard’s and Dillard’s took the position the injury was not foreseeable.
