Sullivan is now moving forward with a bar complaint against Powell and she is screaming for him to be recused from the case. This case is not restoring the public's confidence in the federal courts right now.

He would be foolish to do so, although he did float it out there
She was Flynn's counsel at the time of the letter, the only thing that had not happened, was she had not yet appeared on his behalf in court.
There's a distinction there

It would violate Rule 48 as there isn't consent for such a dismissal. This is a shallow understanding. It will be an abuse of discretion.
