You really can't do that though. It's called the "contemporaneous objection rule" which basically means that such a motion or objection must be lodged at the time of opposing counsel's alleged "offense" or other issue(s) that may arise warranting motion or objection. Or alternatively at the particular time that the objectionable action becomes known to the attorney.

Barnes is right though. He and Richard Baris polled the whole county and had body language experts and everything ready to go. A politically charged case is always gonna be a jury selection case in the social media era.
No doubt, but at some point he needs to stop repeating it.

In many ways jury selection is still much more art than science. People just attach data they like to make it seem more scientific.
Also there is only so much you can actually do in constructing a jury.
I'm not saying he's not a better picker of jurors than the guys who did it, but (a) that's like a person saying they're better at picking stocks...in the long run it doesn't matter and (b) he's giving a very biased and one-sided presentation of that situation.

Yep. It gets old hearing pompous arse Barnes drone on about it but he is 100% correct on the jury.
All it takes is one progressive ideologue on that jury and they are not getting an acquittal.

Is there any question this judge is compromised?

They objected when they were made aware of the different videos.

Exactly. Plus, once the peremptory challenges are used up, you're not guaranteed further strikes. Must demonstrate cause to judge, which of course you know. But those nasty magic words "yes Your Honor, I can set that aside and be a fair and impartial juror" makes it difficult in many cases.

should be scary enough for you. right out there in the open.
Oh, yeah, a jackboot thug group like this WON'T abuse it's powers. Or permit mobs to be in charge instead of equality under the law.

It can be annoying because you know the prosecution deserves a mistrial with prejudice. But I also understand the judge wants to hear what the jury says above all else. I do get that.
Until most moderates and conservatives finally realize that the left doesn’t follow the rule of law and are completely uncivilized and must be treated as such, we are fricked. I hope that the majority wakes up in time and starts treating them like the lawbreakers that they are.

They did, and that was correct. I'm just saying they can't go back and revise the objection after the fact. It's with the judge now, under advisement.

This right here. This is the only way. The left is completely unhinged and irrational. It’s time to go scorched earth.

I don't even understand your point.
The defense objected to different evidence being shared with them when it was uncovered by the defense.
Its a strict liability on the State to give a forensic copy of the evidence to the defense. That's a major problem.

Why aren't they in the courtroom now figuring the video shite out?
Posted on 11/18/21 at 12:28 pm to MindGoblin
So msnbc admits it was somebody under their authority. Kyle should add that to his defamation pursuits.

Because this judge wants to keep the rwst of his docket going.
And the defense seems to be copacetic with allowing this to play out and get potentially two bites at the apple.

I'm not saying it isn't a problem, it is a problem. I was responding to a poster suggesting that defense counsel should go back and amend the objection and/or motion for mistrial.

Yeah. We heard about putting the prosecution under oath and getting a video expert.
And nada. Jury continues to deliberate.
Seems like the judge wants to part of his own threats.

Yet another new poster espousing violence on here. Are you FBI or NSA?

NBC statement:
"Last night, a freelancer received a traffic citation. While the traffic violation took place near the jury van, the freelancer never contacted or intended to contact the jurors during deliberations, and never photographed or intended to photograph them," the network said in a statement to CNN chief media correspondent Brian Stelter.
"We regret the incident and will fully cooperate with the authorities on any investigation," the network added.

Oh good, another lunch and dinner for these morons today.
Why not at this point?
I have a feeling they've been instructed to hold off until Monday, in order to quash the rioting.
