Did anyone else catch that he mentioned that little gem in his speech tonight?

Side note: I thought the speech was great and Kavanaugh came across as very likeable.

Believe it or not, Kagan also follows the same textualist doctrine and frequently applies the same canons of statutory construction (interpretation) as did Scalia. Only difference is she believes that legislative purpose can be considered, and Scalia basically considered that a cardinal sin except for 1-2 extremely narrow circumstances.

On occasion, she has even dissented in cases with Clarence Thomas, where as Sotomayor and Ginsberg joined the majority... See Yancey.

It’s not always conservative v. liberal on the bench.

I have been impressed with Kagan. Yes, she is liberal and I disagree with her most of the time but she does go against the liberals occasionally, doesn’t appear partisan, and her opinions are well thought out (even if they are sometimes wrong)

Took J.Pryor’s statutory interpretation class in law school. He commented multiple times that Scalia and Kagen were close, and that she’s often regarded in the federal judge circle as being the best opinion writer on SCOTUS.
