Justice Clarence Thomas calls for reconsideration of landmark libel case

quote:

If the Constitution does not require public figures to satisfy an actual-malice standard in state-law defamation suits, then neither should we," the opinion states

quote:

"Since he was on the campaign trail, President Trump has complained about libel laws in the United States, and has argued that they should be rewritten," Vladeck said. "Justice Thomas's opinion today concurring in the denial of certiorari is a roadmap to exactly that result."

So will this make CT a racist, sexist, homophobic POS?

Defamation has an amazingly high burden of proof, I doubt removing the actual malice standard will really move the needle very much.

So Juice, are you on record that outlets should be able to print or say whatever they want whether true or not and not be held accountable?

Is Trump going to be held to this same standard? That would be great.

It definitely would, particularly in libel per se states.

I think CT is likely right (that the Court should review state definitions for constitutionality) but that Trump is wrong that laws need to be rewritten.

Not libel questioning and or asking for someone to provide their birth certificate to prove they were actually born in the us does not libel or defame someone

Besides that was the Hillary campaign who started the whole birther controversy
