Afederal judge on Tuesday rejected Gov. Gavin Newsom's, D-Calif., bid to limit the law enforcement activities of the National Guardsmen in Los Angeles to the immediate areas around federal buildings.

Senior US District Judge Charles R. Breyer scheduled a hearing for Thursday, but declined to immediately limit the National Guard's activities. Instead, he sought arguments from both the state and Department of Justice, CNN reported.

Both parties have until 1:30 p.m. on Thursday to submit their arguments. The judge made no comments on the merits of the case.

Even the most leftist judge in the country would toss this out immediately. Under title 10 it is indisputable Trump has the power to do what he did, regardless of how much it makes Gavin cry.

That’s an unearned win for the stupid Newsome; they would have burned and looted that whole city and it would be on his resume.

Man, the California power grid, notorious for failing at completely random times, has a great opportunity to do something funny tonight.

Clear US Supreme Court precedent that this dispute is non-justiciable.

Gilligan v. Morgan, 413 U.S. 1 (1973):

quote:

No justiciable controversy is presented in this case, as the relief sought by respondents, requiring initial judicial review and continuing judicial surveillance over the training, weaponry, and standing orders of the National Guard, embraces critical areas of responsibility vested by the Constitution, see Art. I, § 8, cl. 16, in the Legislative and Executive Branches of the Government. Pp. 413 U. S. 5-12

Imagine being a Governor and suing the POTUS on behalf of criminals that are burning down your state.
