PT lawyers all say yes.
They would also be the first in line to sue an employer who was doing these things (as long as they were getting paid).

There are 2 types of suits involved here. You can sue for damages or other relief, like a restraining order. This was a petition for restraining order, which has a whole different burden, relief, etc. than a petition for damages.
In your example, the parties could probably sue for damages and get beyond initial examination (it's an exception of no cause of action in LA but in other jurisdictions it would be a request to dismiss for failure of the complaint to state a claim on which relief can be granted), but they would never win a petition for restraining order.
The suit in OP is for a restraining order, which they were never going to get.

I know the judge and I know a few of the plaintiffs
the judge had no choice, Tommy Frederick is by the book and the book is pretty clear. So they can appeal
There were over 200 people involved on the plaintiff side, not sure how many of them were named though. They knew this was a long shot, but you have to run it out and this lawsuit was a compromise to quitting.
Now the choice is before them to quit, and their employers know they were involved, so there is about to be a mass exodus of nurses and staff
