The Louisiana Constitution requires the governor to get a recommendation from the Board of Pardons before he can grant clemency to an inmate — and preemptive pardons do not exist in Louisiana, like they do on the federal level, according to multiple attorneys and people familiar with the clemency process.
“You can’t just automatically, with the stroke of a pen, sign somebody out of a criminal conviction in Louisiana,” said Jane Hogan, a Hammond-based attorney who has been practicing before the Board of Pardons for a decade and formerly taught clemency law at LSU.

They will fight this to prevent a conviction of any kind in the first place. They aren’t just punting on that. It should be thrown out on the front end.

Yeah, I mean even in New Orleans a grand jury can’t just, of their own accord, indict a public official for simply doing their job.

They can certainly try. Hence the old adage about indicting a ham sandwich.
It doesn’t mean the indictment goes anywhere or that the prosecutor involved doesn’t get reamed out by the state SC.

It won’t get to that. A motion to quash will be filed and it will be granted at some point along the appellate chain.

The legislature trying to do this for them is what led to their tantrum and the indictment to begin with.
Citizens of New Orleans have the RIGHT to hold hundreds if not thousands of useless government jobs!
