They didn't even see it coming. They allowed a new element of damages (premium refund) to be snuck into the bill that was passed. It's now on the governor's desk. Injury lawyers win again.

I thought they were working on fixing that issue

This is more of a reason for every insurer to pull out of the state.

I'm hearing they are saying they are going to fix it after it is signed during the special session.....I doubt that will ever happen though since I'm sure this "oversight" was agreed to and signed off on by JBE's lawyer buddies.

The government is now actively working against citizens in almost all aspects. What will it take for people to wake the frick up and pay attention to who they vote for?

But they had differences over what is called collateral source.

quote:

The legislation limits what injured parties can be awarded as medical damages to what they actually paid, rather than what the treatment is listed as costing. Because insurance companies contract with specific doctors at lower prices, under the collateral source rule someone with insurance coverage would receive less money than someone without adequate insurance.

quote:

wording was added that allowed injured plaintiffs with insurance coverage to receive reimbursement for at least a year but up to 18 months of premiums at a rate of 1.5 times the monthly cost. Basically, if an injured party buys a family health insurance policy for $1,000 a month, that person could receive $18,000 in additional damages.

quote:

The addition, aimed apparently at incentivizing the purchase of healthcare insurance, wasn’t in the version discussed at 1 p.m.

Did you miss when he called their bluff on the petition to revoke the disaster order?

Just more politicians being useless, loudmouth figureheads only interested in their own personal gain.

I have to laugh when people speak about how glad they are that they live in a "conservative state".

It doesn't matter if you're a democrat in LA as long as you're pro 2A and anti-abortion. Those are the only two republican things the dumb majority in our state care about.

Numerous key republicans are trial lawyers in this process
JBE is their willing accomplice in this but he does not have to work hard to screw up tort reform. Jindal had eight years for everyone republican.
