That is the point they are trying to make - that the SoS’s determination is not subject to judicial review. It’s not really about Khalil specifically, it’s the overarching question of does the Secretary of State have final say on this or a judge?

Mamoud khalil has a green card and is a permanent US resident. He is not here on a student visa man.

Just read up on the case. In fact, just read the article I posted. His legal status when he arrived versus his legal status now are two different things.

There is review of the determination. That statute requires a "reasonable ground" for the Secretary's determination. That would be the issue the courts get to decide.

Well then who gave him the legal right to sit in front of an immigration judge? Where did that come from?

I get your point. That was poor language on my part. What i meant to say is that he's a permanent US Resident.

The law gives him the right. Unfortunately the SOS ruling is determinative in the law. Once the SOS enters his opinion, the judge can pound sand.

If what you say is true, why is Rubio referring to him as an alien then?

Do permanent US residents warrant the term “alien”? You keep saying he’s a permanent US resident so show it.
