Yes and no.

Faking a crime should carry heavy penalties and jail time. Is it as bad or worse than crimes where someone is actually assaulted/raped/killed? No.

Also, "Hate Crimes" should not exist. A crime is a crime. The motivation for the crime should only be considered by the jury.

The punishment should be equal to whatever the maximum penalty would be for whatever crime was staged at a minimum.

It should be prosecuted as a hate crime and should be subject to the same penalties as other hate crimes.
