Because I'm going to have the person arrested for "Riducule based on color, creed, religion, blah blah blah".
Also, if I hear one black person call another black person a "nigg*" I'm gonna report it as a crime.

The law is from 1913 and it appears was meant to be applied to advertising, not private individuals.

It seems like you are almost complaining about this arrest. Why are you suddenly worried about what's "constitutional"? Your side does not care at all about "constitutional" rights. This is another example of "righting the wrongs of four hundred years." Embrace it because it's going to happen more and more. It's also going to cause the unravelling of civilized society but alas, once again this is your side. Embrace the incoming chaos. Pat yourself on the back and consider that you helped usher it in by supporting left wing causes which led to the destruction of civilization.

The parent of the victim thinks the expelled student should be in jail because she is worried about retaliation. Yeah, that's why they go to jail.
