I think its both of them. Specifically, I think the NCHSAA issued the probation, but the school district issued a statement saying their uniform made them a school representatives.
Its unclear to me the grounds that the NCHSAA is alleging in their "probation". In fact, it looks like they are walking back their "probation" to say its a "warning" When pressed it appears the NCHSAA says their is no prohibition on political speech, but that its "against the policy of cheerleading." While its true that many of the other cited items in this thread deal with other school districts, if even one athlete did a Kaepernick kneel in NCHSAA and didn't get prohibition for being against the "Philosophy of Football/Basketball" then it would seem the NCHSAA has some 'splaining to do. It looks like they even let their refs kneel LINK Obviously, players are kneeling too and their isn't any sanctions or "probations" taht I know about. See LINK
More disturbing, the school district is alleging that school policy " bars political advertisements on campus or at school events" That broad a statement looks to run afoul of Tinker v. Des Moines Independent Community School District especially because it was another student and not the cheerleaders that brought the sign.
Additionally and as many have mentioned that could make photographs with candidates who were at the event potentially actionable under their interpretation
