re: Hey Democrats, if Kilmar Garcia isn’t MS-13, why does he have MS-13 tattooed on his hand?

Who removes me on what basis to El Salvador from my country of citizenship?

If the removal is illegal then why would this distinction matter?
It's not more illegal if you're a citizen. It's still illegal at the same as the other removal

Well for one, there are deportation due process procedures for non-citizens involved in criminal acts that are entirely non-existent for US citizens.
So the distinction matters kind of a lot

It's not.
This is the legal scheme being blessed ITT. Now it has to defend its limits.
It's only absurd until it happens.
An El Salvadoran citizen, who was an illegal in the United States, was sent back to El Salvador.
Everything else is window dressing.

Did you ever argue the legality of Biden flying in illegals the last 4 years?

So it's fine when they ignore detainers/holds placed on individuals by the feds?
Well that's a marked shift from the quoted text to which I replied
And answer. It's complicated. And not close to being settled.
Many courts have ruled that the federal government can't require states to enforce these detainers. The argument isn't as much as a supremacy argument, which is what your AI response was focusing on, as much as a 10th Amendment argument about compelling states to act.
quote:
“The Federal Government may neither issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program,” Scalia said. “Such commands are fundamentally incompatible with our constitutional system of dual sovereignty.”

Really bro?
You are literally calling for this to happen right now. You are asking a country (El Salvador) to deport it's citizen to a foreign country (USA).
Good grief. Have some self awareness.

to the extent this is true, the Court probably shouldn't issue orders involving impossibilities
And the govt probably shouldn’t ignore the legal process.
What value do the courts have - if they are going to be ignored?

What law states the removal was illegal?
Its is pretty clear.
You are to be removed to the country you entered the US from.
With exceptions, it cant be a contiguous country if you are not a citizen or resident of that country.
People born in el slavador cant be deported to mexico, the rightful place to deport him to is his nation of birth. That is our law.

Ummmmm…… you are scrambling now. The difference is CITIZENSHIP.
And with that post you just argued against what you have been arguing for all thread.

If they're permitted to engage in illegality and ignore laws, why would these laws matter?

It was legal
I was openly opposed

I'd love for one of these due process purists on the purported right to give us a game plan out of the absurdity they accept.
Ex:
They were largely silent when the last administration left the borders wide open and facilitated the intake of millions of illegal immigrants, including flooding our communities with them using our money.
So they're here, and now they have to go through a costly and lengthy process to be removed. You'd think some of these "really guys, I'm on your team" dudes would spend some of their energy game planning how they can remedy the crushing problem enemies of America have wrought on us via efficient deportation adjudication processes rather that spending weeks demanding we engage in unprecedented foreign relations machinations to solve a non-existent problem.

No. I'm saying the admin is ordered to figure it out
It's not nearly as dramatic as your straw man

When you're authorizing the government to act illegally, why would this matter?

State the law that was ignored, and we can go from there.

They're not permitted to do so. They made an error, and if there is a criminal punishment or monetary comp claim resulting from it, relevant authorities or someone with standing can try and pursue it.
No idea why this isn't enough for you considering it's how we handle this when it happens 1000x a day.
