Of civil rights and individual liberties during this lock down? Or do the emergency orders by the governors supersede the individual’s constitutional rights?

Most people agree and understand the stay home orders. What will be Interesting is to see if protesters rights are violated.

That’s where I think we’ll see legal challenges - and likely rulings that are in favor of the right to assemble and the courts tell the governors to pound sand.

I can’t imagine a court says “you have those rights unless the government says you don’t”.

Because then you never really had them. It’s a farce.

I guess they didn’t technically have civil rights and individual liberties because it wasn’t written down as law, but slavery and Jim Crow were pretty shitty

Well yes, from the historical perspective. But if (back then) slaves were considered property and not citizens, what claim would they have to any rights?

Jim Crow was orders or magnitude worse than this. In many towns, law enforcement was actively persecuting citizens.

In the last 50 years perhaps. Yes.

But Jim Crow was a pretty big abridgement of individual liberty, as was the internment of hundreds of thousands of Japanese, German, and Italian-Americans (yes, people of German and Italian descent were sent to interment camps also).

I am a lawyer but I’m also eating Oreos and milk and giving my daughter a bottle so I’ll be brief: yes, they’re constitutional for the most part. States have police power and can prohibit the time, place, and manner of assembly. Some of my fellow slapdick barrister brethren can take it from there. But you can also start at page 10 of this LINK

If a hurricane hit and there was a mandatory curfew, is that technically an impediment to your rights? Yes.

If there was a war, and the draft was reinstated and you were forced from your family to fight overseas, are your rights violated? Technically yes.

Is pretrial detainment a restriction of your freedom before a guilty verdict? Yes.

Is a Terry stop a restriction of your liberty to move freely? Yes.

Are regulatory policies a violation of somebody’s ability to conduct business the way they see fit? Yes.

The government has certain powers that supersede your rights. They have these powers to protect the population as a whole. These are not a violation of your constitutional rights just bc you want to do something the government says you can’t because it’s either an emergency or for protection of the people.

Governments can create crimes out of behaviors that you deem acceptable but most do not. Governments can declare states of emergencies and restrict your “freedoms” temporarily and your constitutional rights are not violated. Governments can detain you, arrest you, hold you without bond without a verdict of your peers.

You don’t have the right to spread pandemics bc you want to go to the Crab Shack for lunch. You don’t have the right to violate curfews during emergencies or hoard supplies because you want to, or price gouge to make an extra buck. You don’t have those rights. And your movement can be restricted by both federal and local governments for the greater good. And that means you can’t go to work so be it.

The government - local, state and federal have certain powers over you. This country is not a free for all like some believe.
