Hate crime hoax legislation

Is there any such thing that anyone's aware of? This could be a "contact your legislator" situation to voice support for a new law covering this. Federally and locally.

The same could (and should) be said about hate crimes. But if they continue to stand apart so should fabricating one.

That's a good start. But add a sentencing enhancer to, say, the false police report law already there.

It's certainly reasonable to be concerned about all sorts of unintended negative consequences. Much moreso than your typical filing false police report.

If you’re punishing moreso based on speculative ancillary effects due to the perpetrator’s intent in commiting the crime then I don’t see how you can separate hate crime legislation and punishing hoax hate crimes differently.

I think you just punish the act itself without regard for the underlying motivation for commiting it.

Point noted. But id say tht as with any other criminal accusation it would have to be proven beyond a reasonable doubt. Somewhat similar to terroristic threats laws.

Filing a false report is filing a false report. No more need for a new crime related thereto than there is for a new crime of murder or assault, based solely upon the identity of the victim.
