The Senate is just reflecting the House's need for urgency. They wouldn't even wait to see if the subpoenas were enforceable and decided they had more power than the courts. So they made up "Obstruction of Congress" as if literally the last 7-8 presidents hadn't claimed EP and went to the courts before.
McConnel is just helping get the verdict faster, just like they wanted.
