Frick criminal charges. Hello civil charges!
This was not a criminal trial with jury notification of overwhelming evidence (e.g. O.J. Simpson). This is a grand jury that failed to even indict.
The standard of proof for indictment is essentially zero. The same jury pool which supplied the grand jury will also supply the jury in a civil case. If that group of people said that there was essentially no evidence to support criminal charges, do you really think the same jury pool will find more than 50% evidence in support of a civil plaintiff?

Unfortunately, that fictional encounter bears no resemblance whatsoever to that which actually happened.
I looks like Gregory was walking away in the direction of the vehicle, and Ms Durning was following at some distance, talking to her. For whatever reason, Gregaory turned around and walked aggressively back towards Ms Durning, not unlike a MLB manager arguing with an umpire. Ms Durning seems to have lost her balance, fallen and inured herself while backing away.
As such, I would agreed that Gregory was the aggressor, but I see no felony assault here. Maybe the prosecutor overcharged and should have pursued misdemeanor assault. The encounter might have qualified.

She was overcharged and likely would have been subject to a returned information on misdemeanor charges.
