Were they rioting or walking down the street?

Did you keep reading?

“Holcomb, who was called to the stand Wednesday afternoon, seemed to try to talk Perry down. "Aren't you a CDL holder too?" he asked, referring to the men's licenses to carry concealed handguns. "We went through the same training ... Shooting after creating an event where you have to shoot, is not a good shoot."

The dude did exactly want he told his friend! Seems premeditated.

Except, Perry didnt stop his car with his own body nor gun. The rioters stopped.

This idea Perry created this event is detached from reality.

Yes laws were being broken that night and it wasn't from Perry.

a violent disturbance of the peace by a crowd.

However you want to spin it, they stopped Perry point blank and disturbed his peace; at the very least.

Where was the violence when the murder occurred? Only showed a group of people walking down the street.

Not gonna lie. It is pretty sad that y'all don't have anything better to do on Easter Sunday than argue about this all day.

You come across as one of those people that would blame a woman for getting raped if she had rape fantasies.

Y’all are the ones blaming the victim. Sounds like you are referring to yourself.

Is self defense not an affirmative defense in Texas? Is a vehicle considered like a home as an affirmative defense?

If found not guilty by a jury to which Perry was found guilty of murder by a jury!

Yes I did, did you? Nothing in that exchange suggests Perry planned what happened.

Not sure why this is relevant.

That is non-responsive to my question. My question was about affirmative defenses.

I don’t give a shite about either party or what happens going further. I care about the extreme partisanship (on both sides) of outcome determinative results. I am supporting the rule of law. In our society a dispute of facts are determined by a jury. Perry was given a fair jury trial and was convicted.

You are not on your way to enlightenment.

couple of things tigerbaitlawyer seems to be ignoring

perry was in the crowd on 4th street and turned right on congress heading towards the bridge a few blocks away OUT of downtown

not left on congress INTO downtown, if his intent was to incite something he would have turned left

on perry’s car there were 24 sets of unique prints left, his car was surrounded by protesters with a man carrying a long rifle heading right towards the driver’s side door

the arresting detective and the Austin Chief of Police said that Perry should NOT have been charged, the DA pursued this on his own

all it takes on a jury is one or two crusaders to lead the jury to an unjust conviction, the jury convicted on Perry’s intent and disregarded Foster’s intent based on the eyewitness testimony of protesters aligned with Foster

Holy hell. That’s some serious disconnection.

I love these “my proFESsion is upstanding, infallible, outstandingly ethical, and impartial”.

Then everyone turns and looks at the real world.

Do these protest permits typically allow people to block streets or does the permit confine the protest to a sidewalk? Also, does a permit give the protestors a right to surround a motorist?

Not at all sure there was a permit or if there was if it allowed marching in the street. Some do, some don't. It's a matter of fact. The jury would have known.

Not liking the crowd in the street does not excuse driving into it. Common sense tells us not to mix pedestrians and autos.

None of which are elements of the crime nor the affirmative defense. This is a reverse jury nullification and the precise reason the pardon power exists.

Perfect. He'll be legally pardoned.
