couple of things tigerbaitlawyer seems to be ignoring
perry was in the crowd on 4th street and turned right on congress heading towards the bridge a few blocks away OUT of downtown
not left on congress INTO downtown, if his intent was to incite something he would have turned left
on perry’s car there were 24 sets of unique prints left, his car was surrounded by protesters with a man carrying a long rifle heading right towards the driver’s side door
the arresting detective and the Austin Chief of Police said that Perry should NOT have been charged, the DA pursued this on his own
all it takes on a jury is one or two crusaders to lead the jury to an unjust conviction, the jury convicted on Perry’s intent and disregarded Foster’s intent based on the eyewitness testimony of protesters aligned with Foster

Not at all sure there was a permit or if there was if it allowed marching in the street. Some do, some don't. It's a matter of fact. The jury would have known.
Not liking the crowd in the street does not excuse driving into it. Common sense tells us not to mix pedestrians and autos.

None of which are elements of the crime nor the affirmative defense. This is a reverse jury nullification and the precise reason the pardon power exists.
