I don't believe that's correct. I believe that if the NG is under national command the states are out of the loop.

The Catch and Release program is what Trump has been complaining about recently. They are arrested, given a court date, and let go in the US, never to be seen again.
I do remember reading about the ones turned away (and counted as returns by Obama) so I'm not sure why the difference. I will have to look into it some more.

For Katrina, the NG wasn't under "national" command - they all signed cooperative agreements(the Governors, I mean) - it was a big, big mess to avoid martial law and a unified, national control.
Now, the 82nd Airborne did come in. They were armed. There was no declaration of martial law. I have no idea what would have happened if they had shot someone. They were under Honore's command.

Me too, because I understood catch and release to be the ones who were already in the interior and they were just trusted to attend their hearing whereas those detained right at the border don't get a hearing, they are simply turned around and sent back south

I found this in a fox news article:
National Guard soldiers "act as the eyes and ears for the Border Patrol, but by law, do not participate in an enforcement role," the U.S. Army explains on its website. Instead, they're used for surveillance, communications, administrative support, intelligence, analysis and the installation of border security infrastructure.
"The National Guard has been providing Southwest border support for a number of years through our Counterdrug ... program," said Army Maj. Gen. Peter Aylward in a 2010 Army blog post. "Support from the National Guard - but yet a clear division: them not arresting, not engaging in enforcement activities directly attributed to any illegal crossings of either aliens, narcotics or things of that nature ... has worked out very well."
Every site I read says the Guard does not enforce or arrest, they just provide extra surveillance for the border patrol. I wish it could be different and they could forcefully prevent then from stepping over the border.
I have read many articles saying that catch and release AT THE BORDER is the standard operating procedure...nobody is turned around and sent back. Here's just one article:
