There is always the prospect of a no bill. Unless people know something that has yet to be officially announced. Just because a new USA is there, it does not mean that it automatically means an indictment by a Federal Grand Jury.....especially if they are considering a count like this not in conjunction with a wider crime.
They could go Scooter Libby for misremembering something he did, then claiming he lied because he was mistaken as to some of the particulars

Not sure that matters. We know he lied to congress multiple times about the particulars around an investigation into a presidential campaign and president. Look around if you are actually curious. There are several videos floating around of him lying.... pick one.
