um - you know that manslaughter is a lesser murder charge - right?
and I am pretty sure in that situation, the DA can up the charge to murder
don't know for sure - prove me wrong
Umm, I'd love to forward you to florida statute 782.04... it dictates "felony murder" as maxing about as a first degree felony. Dui or other vehicular manslaughter (782.071) maxes as a 2nd degree felony. It is literally the difference between 15 years and an elbow, unless you don't stop after said accident. Check your syllabus for the final exam date.

that sounds fantastic
if you want to repost that in plain English, that would be great
are you saying the difference is 15 to life vs judges discretion?

No, that's the difference between a 2nd degree felony and a 1st degree, in florida. Judge discretion has nada to with this. Only thing that can save you is mitigating circumstances and low score sheet.

If it's not your house don't break in
If it's not yours don't steal it
If you choose to disregard these two rules...your arse may die
Atta boy to the home owner

The home owner being absolved of criminal charges doesn't preclude civil penalties.
Which is a fricking shame.

If I recall correctly, the HOA where George Zimmerman lived paid a million dollars out through its insurance to the family of Travon Martin.

I think you should either run for office with this as a central issue in your campaign OR find a candidate to support that will champion this cause
be sure to come back and give us an update & let us know how that works out for you...

Now that is injustice!

Too bad that all of history, which reserved a certain word to mean the intentional killing of a person by another person, can't have a vote in it.
Instead we'll have to live with the muddled emotional thinking of today's mental midgets in charge.

From what i read, this guys only mistake is not removing the plug from his shotgun. Then he might have killed all three of those A-holes.
His neighbors should thank him. That street just got a little safer.

Fully in agreement with what this guy did. You got 3 dudes in BROAD fricking daylight beating down your door. Just by this action alone, you already know they are crazy and probably armed. I say lay them all out with that 12 gauge. It's too bad he didn't get the other two.

I disagree with broadening the definition of "murder" to include acts where the people you charge with murder didn't intend to take anyone's life. It just doesn't make sense.
That is not even fuzzy thinking.
The driver of the getaway car is aiding the 'inside guys' on a bank robbery to commit a felony. If he says, "I am not doing that; it's not worth the risk," then maybe no crime is committed at all. If the inside perps shoot and kill someone, he is responsible for that too.
That penalty 'by association' serves an important need of society. Isn't that easy to see?
If I could I would sentence you to watch "Haywire" three times back to back. No, wait. It rocks.

A big safeguard people have in their homes is anonymity. The perps want your stuff and they don't care about your life. What they do care about is the shot gun, pit bull, half drunk former military guy ranting on the Rant - or all three - that might be behind door number one.
Recall that the two perps in "In Cold Blood" drove 400 miles straight to the victims' house based on information they learned in prison.

Maybe.
Zimmerman was the 'security coordinator' for the HOA and his name and number appeared in the HOA newsletter - "Any problems, just call George."
Really.
