What everyone is not talking about is the way this lawsuit was handled by defense counsel. The burden of proof in a civil case is on the plaintiff just as it is on a state prosecutor in a criminal trial. However, in a civil matter it is not guilt beyond a reasonable doubt as in a criminal prosecution, but it is proof by a preponderance of the evidence. The jury weighs the testimony, evidence, the demeanor of the witnesses, the arguments of counsel and the instructions of the judge in reaching its verdict supported by a “preponderance” (in their subjective view) of the evidence. In this case, Carroll’s testimony, the testimony of her two friends that she told of the attack contemporaneous with the alleged event, and other evidence submitted went unrebutted by defense counsel’s case presentation except to let her client claim the plaintiff was a lunatic and not his type. Zero countervailing evidence. Frankly, given the trial court record, the standards for appellate review and the tarnished record of defense counsel, I do not see this case getting reversed. There’s a possibility that the quantum award for damages may be reduced, but most of that is a separate award for defamation after the trial on sexual assault.
