Bush appointee, dismissed the indictment because of ‘insufficient evidence to sustain the conviction.’ “The evidence was insufficient as a matter of law for the jury to convict Rafiekian on either count,” Judge Trenga wrote in a 39-page memorandum last Tuesday. “There is no substantial evidence” that he agreed to cooperate subject to the direction/control of Turkey; no evidence of any implied agreement with Turkey.

Hopefully this Sullivan judge is not swampy and just dismisses the case.

Unfortunately he could take the prosecutors recommendation and just move to sentencing.

After well over a year of this stuff they moved to sentencing and Flynn gets 20 hours of community service.

Look, I don't like proprietorial shenanigans, but Flynn pled guilty and waived any right to additional discovery. How is it an outrage not to allow him more discovery which is only relevant in the guilt phase?

But circumstances changed because his original duplicitous defense attorneys did not seek this Brady material which is exculpatory.

They made the calculation that it's less risky having the trial dismissed than revealing exculpatory evidence.

Releasing Brady material will likely open up Pandora's box a little wider. They don't want that.

What's scary is there are still players in the DOJ trying to frick over innocent people. Still trying to convict someone with out producing all the evidence to the defense is 3rd world country shite that shouldn't happen in America.

There are a lot of innocent people who are in prison because they pled guilty to avoid the risk of a trial. Should they all get to send post-plea discovery and continue to litigate guilt?

You people simply believe that the law doesn't apply to conservatives. Good luck with that.

Mr. Bamarep, they are too stupid to do research and come to a factual conclusion. They have to be told what to believe, and what is true and what is false. The supporters of communism on this board are some of the dumbest forum posters that I have ever seen. At some point, there will be an outbreak of violence between the left and the patriots. That outbreak will last only a short time because the leftists are too stupid to form anything close to a winning battleplan. They will continue to push until peaceful, decent people finally get enough and our push back will be monumental. They would rather see our nation destroyed than to not get their way

So basically a group of DC jurors convicted Flynn's business partner on no evidence.

So what did they convict him on, then? Just the arguments presented by the prosecution?

This is why nobody associated with Trump will ever get a fair trial in DC for anything. There are no objective peers up there. That town voted 95% for Hillary and is an Establishment swampland.
